Adidas has accused Fashion Nova of infringement, unfair competition, breach of contract, and other offences in a complaint submitted to a federal district court in California. Adidas claims that the fast fashion retailer has a “propensity for overlooking the intellectual property of others.”
Fashion Nova, located in Los Angeles, operates five retail stores in Southern California and has a social media following of over 25 million, which includes celebrity fans and collaborators.
Fashion Nova was sued by Adidas in the past for allegedly utilising “identical, confusingly similar, or substantially indistinguishable imitations” of the three-stripe symbol on clothing and shoes. Fashion Nova agreed to cease selling items that resembled the Adidas three-stripe brand as part of a 2022 settlement between the two businesses.
Adidas claims that Fashion Nova is once again “selling many of the same designs it had promised to stop selling.” Additionally, Adidas objected to Fashion Nova launching a “completely new collection” of footwear and apparel featuring “confusingly similar or nearly identical imitations” of the iconic three-stripe design.
