The Delhi High Court has recently given a go-ahead to Crocs Inc., to take ahead the case of infringement, according to which the Indian footwear brands Liberty and Relaxo, along with Czech Republic-based Bata are amongst the brands accused by Crocs Inc., of allegedly copying their popular rubber clogs design.
With this permission, the Crocs Inc., will pursue the nine-year-long case that couldn’t proceed in 2019 as per the Indian court, due to technical reasons. As per the the earlier court challenge, the Crocs Inc., had stated that its rivals should be stopped from making and selling footwear, which bears resemblance to their rubber clogs
But Liberty also challenged the statement by arguing that Crocs too had copied the design and structure of the clogs and that it was not the original and sole originator of these clogs. With the court case now resuming, this particular style of clog has its own dedicated following because of its bright pop of hues and comfortable resin, and over a period of time, these shoes have been sold by a number of footwear brands in India.
