Apparel retailer J C Penney Company, Inc, which was sued by British luxury fashion brand Burberry Limited, for alleged trademark infringement, has stated that the retailer is “fully indemnified by the supplier, and therefore any damages awarded in the case will be fully covered by the supplier”.
The retailer had sold jackets and scarves knockoffs of Burberry’s famous ‘Burberry Checks’ that were supplied by the Levy Group. This design, made in its original red, camel, black and white color combination apart from other combinations, have been their signature style since the 1920s.
In a complaint, filed in a US district court in Manhattan on February 9, Burberry had accused JC Penny of illegally selling quilted jackets and scarf coats, having Burberry’s signature designs, for the past two months. Manhattan-based distributor Levy Group had also been named as a defendant for supplying the infringing merchandise.
It has added that the lawsuit will have no financial impact on the company. Although, it can not be determined at the moment what the ultimate outcome of the lawsuit will be, the Company feels that the final outcome of the lawsuit will not have any materially adverse effect on its results of operations, financial position, liquidity or capital resources.
